High Court Blocks Petitions Seeking Removal of Chief Justice Martha Koome and Supreme Court Judges

The High Court has dismissed multiple petitions seeking the removal of Chief Justice Martha Koome and other Supreme Court judges from office. The petitions, which alleged misconduct and failure to uphold the Constitution, were rejected on the grounds that they lacked substance and did not meet the constitutional requirements for the removal of judges.


In a ruling delivered by Justice John Mativo, the court found that the petitions did not provide sufficient evidence to warrant the removal of the judges. "After careful consideration, the court has found that the petitions against the Chief Justice and the Supreme Court judges do not meet the constitutional threshold for their removal from office," Justice Mativo stated.


The petitioners had argued that the judges' decisions, particularly their ruling in the high-profile 2022 presidential election petition, were biased and politically motivated. However, the High Court emphasized the importance of an independent judiciary and noted that such petitions could not be used to undermine the integrity of the judicial process.


"The judiciary must not be undermined by frivolous claims intended to achieve political ends. The rule of law must prevail, and the judges in question must be allowed to carry out their duties without fear or favor," Justice Mativo added.


The court's decision has generated mixed reactions. Supporters of the ruling praised it as a victory for judicial independence, reinforcing the need to safeguard the judiciary from political interference. On the other hand, some of the petitioners and their supporters expressed disappointment, claiming that the court failed to address the serious concerns raised in the petitions.


The ruling comes at a time when the judiciary's independence has been a topic of intense public debate, especially following controversial decisions in high-profile cases. The decision to block the petitions is seen as a clear message that the court is committed to maintaining its autonomy and upholding the rule of law, despite political pressures.
