The Kandara Residents Association has strongly opposed the ongoing surveying, subdivision, and issuance of title deeds for land in Muranga County, claiming the process disregards the legal requirements and previously agreed-upon agreements regarding land allocation.
In a statement released on April 3, 2025, the association expressed its dissatisfaction with the current handling of the land allocation, specifically relating to LR No. 12257/8, located in Makenji, Muranga. The association claims that the entire parcel of land is being allocated to the Muranga County Government without adhering to the 70:30 land-sharing formula as determined by the National Land Commission (NLC) and endorsed by the 12th and 13th Parliaments.
The NLC had outlined the necessary steps for the process to proceed, including a formal request from the County Executive Committee Member (CECM) in charge of Lands, Muranga County, in line with Section 12(1) of the Land Act. Among the stipulations was the requirement for an approved Physical Development Plan, an authenticated survey, and a list of beneficiaries. Kandara Residents Association claims that a list of beneficiaries, which was adopted by the National Assembly’s Lands Committee on August 17, 2023, has not been properly incorporated into the ongoing process.
According to the association, the allocation of the land solely to Muranga County Government, without considering the agreed-upon formula, amounts to a denial of the Kandara residents' rights and is akin to historical land injustices caused by past land dealings, particularly with companies like Delmonte Kenya Ltd, Agrofrench, and Kenya Canners. The association also argued that such actions would be a modern-day form of oppression, drawing a parallel to colonial-era land dispossession.
Additionally, the statement pointed out that this ongoing process violates a directive from President William Ruto, which instructed that the Kandara Residents Association should be granted their titles by February 2024. The association is now calling on government agencies to ensure the land allocation follows the 70:30 sharing formula, as recommended by the NLC and Parliament.
"We appeal to all Government agencies to implement the allocation of LR No. 12257/8 as per the NLC determination, ensuring the 70:30 land-sharing formula between Kandara Residents Association and Muranga County Government," the association stated.
The Kandara Residents Association is calling for a fair and transparent process that respects the rights of the local community, urging that their long-awaited land entitlements be honored in accordance with the legal framework established.
