Eldoret :13 Nominated UDA MCA’s Take Oath of Office
Thirteen United Democratic Alliance ( UDA ) party nominated Members of the Uasin Gishu County Assembly took an oath of office yesterday after battling in the corridors of justice for nearly two years to get justice.
This was after the High Court sitting in Eldoret revoked the nomination of their predecessors who had taken their slots in the County Assembly of Uasin Gishu on the ground that they had been gazetted illegally.
Speaker of the County Assembly Philip Muigei presided over the two hour ceremony that was graced by close family members and friends of the MCAs.
The MCAs who were sworn in under the gender top up list include, Caroline Jeptanui, Cherono Caroline, Tirop Everline, Serem Naomi, Ngetich Pamela, Sharaon Jewel Kogo, Bungei Veronica Celestine Mutai and Rebecca Jerop.
Others were Kiplagat Gerald, Wambui Tabitha, Kering Robert Kiptanui and Regina Chumba who were under the special category.
In a ruling that was delivered by Justice Reuben Nyakundi last month he stated that the former nine MCAs were illegally gazetted by the Independent Electoral and Boundaries Commission despite the fact that the Political parties Tribunal had rejected their list.
The Judge directed that the polls agency de-gazette the names of the nine MCAs within 14 days.
The MCAs who were sent packing are James Wachira, Belinda Chebichi, David Waiganjo, Roda Kemboi, Nancy Kiboi, Hassan Chepkoech, Sahra Abdi, Magrine Chebet and Juliet Chelimo.
According to the Judge, the genuine list of the nominated MCAs was the one dated July 27, 2022 and not the one filed by UDA on August 24, 2022.
It emerged during the court hearing before the Chief Magistrate’s Court that the nine MCAs were not in the original list of nominated MCAs filed by UDA.
The Chief Magistrate Dennis Mikoyani who presided over the matter ordered that the initial list dated July 27, 2022 should be applied.
Aggrieved by the Chief Magistrate’s court ruling the former MCAs moved to the High Court where they were dealt a major blow for a second time in a row sealing their fate.
