Energy Committee Uncovers Irregularities in Disputed Oil Consignment Investigation

The National Assembly’s Departmental Committee on Energy, chaired by Hon. Vincent Musyoka, in a meeting exposed irregularities in the documents submitted by Ann Imports and Exports Enterprises Limited about the contentious oil consignment.

During the Committee meeting, Ms. Anne Njeri Njoroge faced scrutiny as she presented documents that were deemed illegible. Notably, a tax compliance certificate contained a typographical error, and the CR12 certificate from 24th August 2023 revealed discrepancies in the distribution of ordinary shares, raising concerns with 998 shares unaccounted for. Njoroge also failed to disclose the names of five companies she claimed to have supplied oil to in the last five years, the country of origin for the cargo, and the payment method for the shipment.

Moreover, she declined to share her banking details, citing confidentiality concerns for both her documents and clients.

Contrary to Njoroge’s assertions, Galana Energies claimed rightful ownership of the disputed consignment, providing supporting documents such as the certificate of quantity, a letter of nomination from the Ministry of Energy and Petroleum, an import declaration form, and a pre-verification of conformity letter.

Addressing the ownership matter, Capt. William K. Ruto, Managing Director of Kenya Ports Authority (KPA), clarified that Ann’s Import and Export Enterprises Ltd. was not listed among the manifested consignees. He provided GPS tracking details of MT Haigui, emphasizing that Galana Energy was the legitimate owner, with M/s Aramco Trading Fujairah as the designated shipper nominated by the Ministry of Energy and Petroleum.

Responding to the Committee’s concerns, Energy CS Chirchir, accompanied by the PS for Energy & Petroleum and CEOs for EPRA, Kenya Power, GDC, KETRACO, and KENGEN, disclosed that Ms Anne Njeri Njoroge had presented ownership documents to his office. He advised her to report the matter to the Directorate of Criminal Investigations (DCI) for a thorough investigation.

CS Chirchir also shared strategies for mitigating national power blackouts, including the segregation and unbundling of the transmission and generation network, enhancing power dispatch from the Turkwel hydropower plant, and implementing alternative supply solutions for Kitale and Eldoret.

Additionally, he highlighted the installation and commissioning of a transformer at Kitale Substation and the completion of the Kimuka substation to address voltage drops and power fluctuations.

In his concluding remarks, Hon. Musyoka stated that the evidence presented to the Committee is sufficient to conclude the investigation. He urged the Ministry of Energy and Petroleum to swiftly implement the outlined mitigation measures to address persistent power outages across the country.
