Hill school Eldoret Principal, Testifies in His Sons’ Murder Case
In the ongoing murder trial of Lawyer Abel Mogaka, the alleged killing of Lawyer Calvin Ngaira Musachi on May 18, 2019, in Eldoret’s Annex Area, Uasin Gishu, two witnesses presented their testimonies today before Justice Wananda Anuro.
Hesbon Ngaira, the father to the deceased expressed the anguish of receiving the distressing news of his son’s fatal stabbing.
He conveyed the emotional impact, stating, “The news of his passing on would later reach his family through their daughter.”
During the proceedings, the accused lawyer Oburu Nathan directed a question to the inspector, inquiring, “What were your objectives at the scene of the crime?” Implicit in this query was the assertion that the inspector’s role, ostensibly as an expert, had been eclipsed by that of an investigator, thereby questioning the appropriateness of the inspector’s involvement in investigative tasks.
Subsequently, the lawyer turned his attention to Mr. Ngaira, the father of the deceased, and inquired whether the witness had observed any bandages on the accused, Mr. Mogaka, during a purported encounter at Mediheal Hospital. This line of questioning aimed to probe potential discrepancies or notable details in Mr. Mogaka’s physical condition at the time, adding a layer of scrutiny to the circumstances surrounding the accused’s alleged involvement in the crime.
Another crucial witness, an inspector responsible for processing the crime scene, informed the court that no murder weapon or indications of struggle were discovered at the specified location.
To date, five witnesses have testified, and an additional seven are slated to provide their accounts on June 12 and 13 next year, indicating a comprehensive examination of the case.
However, amid the legal proceedings, the family of the deceased has voiced concerns over the protracted nature of the trial, urging the court to expedite the hearing and resolution of the matter. Emphasizing the urgency, they are contemplating a request for the reassessment of the accused’s bond terms, alleging that Abel Mogaka continues to move freely.
The family’s plea underscores their desire for a swift and equitable resolution, adding a layer of urgency to the judicial proceedings.
