Lands Committee Rejects Land Registration (Amendment) Bill, 2023

The National Assembly’s Departmental Committee on Lands has formally rejected the Land Registration (Amendment) Bill, 2023, which was sponsored by Nakuru Town East MP, Hon. David Gikaria. The decision, made during a meeting chaired by Bondo MP, Hon. Gideon Ochanda, came after the Committee raised concerns over contradictions between the proposed amendments and existing regulations.

One of the key issues identified by the Committee was the proposed amendment to extend the timeline for issuing titles or leases from the current four days to 30 days. The Committee noted that this change contradicted the timelines set out in the current Service Charter, which guarantees the issuance of titles or leases within a shorter period.

In addition to these concerns, the Committee highlighted the absence of Hon. Gikaria, the sponsor of the bill, who had been invited four times to present and defend the proposal before the Committee. Despite multiple invitations, the sponsor did not attend, leaving the Committee without clarification on several points of contention.

“As a result of these issues, the Committee resolves to reject the Legislative Proposal in its entirety,” said Hon. Ochanda in a statement.

The Committee had previously engaged with the sponsor and received submissions from the Kenya Law Reform Commission (KLRC) during the proposal’s consideration. Following its rejection, the Committee’s report, detailing the reasons for rejecting the bill, is expected to be tabled in the House for further deliberation.
