Rough Penalties For Worst Forms of Child Labour-Esther Wasige
A person who engages a child on the worst forms of child labour will face tough penalties, County Director for Children Services Esther Wasige has disclosed.
Wasige was making a presentation during day two of a three-day workshop for Busia journalists on the role, in raising awareness of child labour and forced labour at Chef West Hotel on Tuesday sponsored byTdH Netherlands, 2022.
” A person found calpable offence will be liable to a fine not exceeding Ksh200,000 or imprisonment for a term not exceeding 12 months or both, ” the County Director said.
Ms. Wasige said the Childrens Act also bars people from employing children between the ages of 13 and 16 to operate machinery work unless they are working with a skilled worker to earn or to learn and work for a specific period of time.
Wasige added: ” No person will employ a child in any industrial work between 6.30p and 6.30am unless a male young person is employed in cases of uncontrollable or unforeseen emergencies.
She noted that the cabinet secretary, in consultation with the board, authorizes the employment of a young person for a specified period of the right in accordance in with the rules set.
She went on: ” The law is also very clear that a person employing a child must keep a register containing the following details for each child, age and date of birth, date of starting and having employment and any other details required.
Wasige said if a child is killed, dies, or suffers bodily injury in consequence of his employer, having contravened any provision of his part, his employers shall be in addition to any other penalty to a fine not exceeding Ksh500,000 or imprisonment for a term not exceeding 12 months or both.
