𝗥𝗲𝘀𝗶𝗱𝗲𝗻𝘁𝘀 𝗼𝗳 𝗝𝗼𝗺𝘃𝘂 𝗖𝗼𝗻𝘀𝘁𝗶𝘁𝘂𝗲𝗻𝗰𝘆 𝗣𝗲𝘁𝗶𝘁𝗶𝗼𝗻 𝗡𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗔𝘀𝘀𝗲𝗺𝗯𝗹𝘆 𝗢𝘃𝗲𝗿 𝗨𝗻𝗳𝗶𝗻𝗶𝘀𝗵𝗲𝗱 𝗠𝗼𝗺𝗯𝗮𝘀𝗮 𝗣𝗼𝗿𝘁 𝗔𝗰𝗰𝗲𝘀𝘀 𝗥𝗼𝗮𝗱
Twalib Bady Twalib, MP Jomvu Constituency has this afternoon read a petition on behalf of Mombasa West Community Project Affected Persons on the dire state of the Mombasa Port Access Road project. The residents are seeking urgent intervention to address the incomplete construction and the inadequate compensation for those affected by the project.
According to Hon. Twalib Bady, the 41.3-kilometer Regional Mombasa Port Access Road project, initiated by the Kenya National Highway Authority (KENHA), was envisioned as a crucial infrastructure development aimed at improving connectivity between the Port of Mombasa and neighboring countries. However, the construction work has come to a standstill in Jomvu Madafuni, leaving the road in a deplorable condition despite its significant role as the gateway to Mombasa.
Financed by the African Development Bank, German KfW, European Investment Bank, and the EU-Africa Infrastructure Trust Fund, the project was intended to include compensation for all Project Affected Persons along the corridor. However, in 2014, KENHA prepared a flawed Resettlement Action Plan that failed to utilize Geographic Information System (GIS) for asset inventory tabulation. Moreover, the project was later claimed to be on public land, creating confusion and hindering fair compensation.
The petitioners claim that the National Land Commission, responsible for valuation, conducted an ambiguous assessment that resulted in unjust treatment of Project Affected Persons. In May 2017, without prior notice, KENHA forcibly evicted residents of Jomvu Constituency from their homes, further exacerbating the situation. Furthermore, the Final Compensation List issued by the National Land Commission omitted numerous residents and property owners, aggravating the injustices faced by the affected individuals.
The petitioners have urged the National Assembly to take immediate action to ensure fair compensation for the Project Affected Persons in accordance with the true value of their assets. They also demand transparency in the disclosure of the Valuation Report Feedback. Additionally, they request the National Assembly to direct KENHA to implement a Corrective Action Plan that was agreed upon with the Project Affected Persons and to adopt the use of Geographic Information System in the asset inventory process.
The matter was referred to the Public Petitions Committee.
