Justice and Legal Affairs Committee Lauds Judiciary’s Efforts to Ease Access to Justice with E-Filing and Alternative Justce Systems
A section of Members drawn from the Justice and Legal Affairs Committee (JLAC) has lauded efforts by the Judiciary to launch the E-filling & Alternative Justice System (AJS) at the Kakuma Law Courts; in a bid to reduce the backlog of court cases.
Speaking during the ceremony, Hon. Stephen Mogaka (West Mugirango) and Hon. John Kaguchia (Mukurwe-ini) who represented JLAC’s Chairperson Hon. George Gitonga Murugara (Tharaka), noted that in our rapidly evolving world, there is need for the judicial systems to move with the pace.
“The introduction of the E-filing and Alternative Justice System Suites is not only an upgrade but an embodiment of our commitment to a more efficient, inclusive and responsive legal framework. This initiative signifies more than digitalization; it embodies our Constitutional duty to provide accessible justice for all.” Said Hon Mogaka.
With the world becoming a global village and with the easy access and affordability of technology, the Legislators noted that individuals, regardless of their location, can now access legal services, ensuring that justice is not delayed or denied; in line with
Article 48 of the Constitution of Kenya, that mandates that every person has the right to accessible justice.
On the Electronic Filing (E-filing) system which has so far been launched and deployed in five Counties; with plans underway to cover the remaining Counties, the Leaders noted that it will help establish a system that is impartial, easily accessible, effective, and upholds the rights of everyone, especially the most vulnerable.
The Chief Justice and President of the Supreme Court of Kenya, Lady Justice Martha Koome, noted that AJS offers more than just a resolution to disputes.
“Our rich tapestry of traditions upheld by our elders; has always provided pathways to justice. The people of Turkana have long upheld these traditions, and I urge you to view the introduction of AJS as a symbol of our commitment to preserving and promoting this wisdom. The Judiciary has embraced a multi-door approach to justice delivery.” Affirmed Lady Justice Martha Koome.
The Leaders also called on the Judiciary to anticipate and address any challenges that may arise during the transition including adaptation to technology, ensuring all stakeholders are well-prepared to navigate the digital landscape, and installing robust cybersecurity measures to safeguard the integrity of our justice system.
