Eldoret: Nominated MCA’s to Know Their Fate Tomorrow

Nine out of the 13 nominated United Democratic Alliance party MCAs to
the Uasin Gishu County Assembly will know their fate on September 1st 2023.

This after the judgment was scheduled for today but postponed to Friday at 3:00 pm.

Justice Stephen Riech is expected to deliver the judgment .

The affected MCAs were dealt a big blow on March 14 this year; when Eldoret Chief Magistrate Dennis Mikoyan nullified their nomination terming it illegal.

Aggrieved by the degazettement of their nomination in party list published on September 9, 2022, the disgruntled MCAs moved to the High Court to appeal the law court’s ruling.

Mikoyan’s judgment follows a case in which two petitioners, Celestine Mutai and Robert Kiptanui had filed against the UDA party and the IEBC seeking the revocation of the nine nominations.

The two had argued in their petition that despite applying for nomination as MCAs and qualified, their names were removed from the list thereby contravening their rights to fair administrative action.
According to the petitioners despite the nomination being conducted according to the constitution of Kenya,the names of the disabled and women representatives were not in the list as expected.

“We are here together with our fellow collegues whose names did not appear in the nomination list,we presented the case in the court because we felt the need of the disabled and the women being represented equally,” said Timothy Cheruiyot.

One of the vulnerable said they have been waiting for long the ruling to happen and they have full faith in the court on finding justice to diminished groups.

“We would like to thank the court for taking such a step and we have faith they will deliver justice and we pray to God for the ruling to be fair for we have been denied our rights for a very long time,” he said
