Case Over Multi-Billion Muslims Assets in Eldoret to Go To Full Hearing
A High Court in Eldoret has ordered a case seeking to permanently bar trustees of the Muslim Association Eldoret Jamia Mosque to go to full hearing.
The ruling was issued on Thursday, April 21, 2022, in a virtual court session.
Petitioner Jamal Diriwo Mungatana, the Secretary General of the North Rift Muslim Youth Daawa Group, had filed the case seeking to among others orders for an audit of all association’s properties since 1990.
Diriwo also wanted the current trustees of the association blocked from holding any positions – accusing them of illegally being in office, as there has never been an election and mismanagement of the Jamia Mosque assets.
He had sought temporary orders for a caretaker committee to be appointed pending hearing and determination of the case, and appointment of an independent auditor to audit all the Muslim association assets since 1990.
“We want an audit done since 1990 because that is when proper audit was done for the Muslim assets. This is also a year we had an election held,” said Diriwo.
The court however declined to direct appointment of a special auditor to look into the muslim association’s assets.
It instead asked that the matter goes for a full hearing.
“On our side, we do not agree with the court ruling because we wanted a care taker committee appointed and the defendants be out of the control of the association as the case continues,” said the Secretary General of the North Rift Muslim Youth Daawa Group.
“It would also be fair for an independent auditor to be appointed so that we get to know the truth about the current status of the Muslim Association, Jamia Mosque Committee,” he added.
Diriwo claims the current Jamia Mosque leadership has illegally converted some of the Muslim assets into private properties.
But with the court’s ruling, he now hopes that his push for the association to be managed by legitimate officials and all assets accounted for is still on course.
“Our petition remains intact and we’re now waiting for the directions from the court of when the hearing for the case will start,” he said.
