High Court Suspends Implementation of Adani Energy Project Agreement Amid Legal Challenge
The High Court of Kenya has issued conservatory orders to suspend the implementation of the Project Agreement between Adani Energy Solutions and the Kenya Electricity Transmission Company Limited. This ruling comes as a response to a petition filed by the Law Society of Kenya (LSK), which questions the constitutionality of the agreement.
Faith Odhiambo, President of the Law Society, expressed concerns regarding the lack of transparency surrounding the public-private partnership (PPP) and criticized the expedited procurement process that led to the agreement. She emphasized the importance of protecting Kenya’s sovereignty and maintaining control over national assets, resources, and infrastructure.
Odhiambo stated, “While PPPs aid additional development, they must strictly adhere to the Constitution, the PPP Act, and the Public Procurement and Asset Disposal Act (PPADA) to safeguard the economic viability of our resources.”
The Law Society is determined to pursue the legal challenge to its conclusion, advocating for a resolution that serves the best interests of all Kenyans. The case highlights ongoing concerns about governance and the management of public resources in Kenya’s evolving infrastructure landscape.
