The Supreme Court has upheld the Court of Appeal’s ruling to nullify the election of Harrison Garama as the Member of Parliament for Magarini constituency. The decision comes after Garama’s election was challenged on grounds of gross irregularities.

Garama’s victory in the previous election was deemed invalid as it was found to have not adhered to constitutional and legal requirements. The Supreme Court’s decision affirms the earlier findings of the Appellate Court, underscoring the necessity for adherence to electoral laws and procedures.

With this ruling, the Independent Electoral and Boundaries Commission (IEBC) is now tasked with organizing a by-election in Magarini constituency. This presents constituents with the opportunity to choose their representative in the National Assembly through a fair and transparent electoral process.

The five-judge apex court’s verdict highlights the importance of upholding the integrity of electoral processes and ensuring that elections are conducted in accordance with the Constitution and the law. Garama’s loss of the parliamentary seat underscores the consequences of electoral malpractices and the judiciary’s commitment to upholding democratic principles.
